- For the purposes of this Agreement, the Company is authorized to collect, receive, use, transfer or otherwise process the personal information provided by the Passenger to the Company. The personal information provided by the passenger to the company will be used only for the purpose of providing the service. If the passenger agrees to these terms and conditions, the passenger gives the company the right to use personal information in the manner established by the same agreement;
- Service fee
2.1 In return for the service, the passenger pays the company a service fee. The company’s service fee is 35% of the amount paid/deposited by the airline, which will be retained by the company upon transfer of the amount by the airline. Here, the parties agree that if the company applies to the court with a request for compensation, then the company’s service fee will increase and will be 50% of the amount paid/credited by the airline.
2.2 The parties acknowledge that if the Company’s efforts are unsuccessful and the Passenger fails to receive compensation, then the Passenger is released from any obligation to pay any fees;
2.3 The parties agree that the company cannot guarantee the successful completion of the case to the passenger, although it will try to protect the passenger’s interests as much as possible, and the company will receive the service fee only in case of successful completion of the case;
2.4 The passenger declares his consent and authorizes the company to deposit the compensation paid by the airline directly to the company’s bank account. The company is obliged to transfer the compensation, minus the service fee (which also includes and takes into account the additional costs, which are listed in this document if any), to the passenger’s bank account within a reasonable period of time. The company will transfer the amount stipulated in this paragraph in national currency, at the rate determined by the company’s servicing bank at the time of transfer.

2.6 The parties agree that the Company shall not be liable in case of difference between rates, and in case of compensation, any transaction fee shall be borne by the passenger.

3.1 The company has the right to request the passenger to disclose personal information necessary for the identification of the passenger. Such information may include (but is not limited to):

– name and surname;
– telephone number;
– address, country, region, postal code, city;
– Cookies and service usage data.
3.2 The passenger declares his consent in advance that the personal data specified by him in the order form may be used for the following purposes:
3.2.1 to identify the passenger;
3.2.2 to respond to or process a passenger’s question, complaint, request or recommendation;
3.2.3 to process payments;
3.2.4 to provide marketing information about the Company’s services, marketing events, initiatives or other promotions;
3.3. The passenger agrees in advance that the personal data indicated in the order form may be transferred by the company to third parties, including the company’s service providers, judicial, governmental and regulatory authorities (both in Georgia and abroad) for the purpose of providing services.
3.4 The passenger is obliged to provide the company with any information upon request, including the boarding card, flight information, correspondence with the airline. The passenger takes responsibility for the accuracy and completeness of the information provided;
- Validity and Termination of the Agreement
4.1 The company starts acting on behalf of the passenger after receiving/completing the order form and signing the relevant power of attorney form. The company will deliver the power of attorney form to the passenger to the e-mail indicated by the passenger;
4.2 This contract will be automatically terminated after the passenger receives the appropriate compensation, and the company is also entitled to unilaterally terminate the contract if it considers that the passenger’s claim has no prospect of satisfaction, the company will inform the passenger in writing.
4.3 The company has the right to unilaterally terminate the agreement if the passenger grossly violates the terms of the agreement, submits incomplete or inaccurate information to the company. In addition, if the company has incurred costs for this service, the passenger is obliged to compensate for these costs as material damage caused to the company.
4.4 The passenger has the right to refuse the service at any time and to notify the company in writing about this, except when the company has already started providing the service (applied to the airline) and paid the expenses for the provision of the service, in such a case the customer will be obliged to reimburse the present expenses.
4.5 The passenger declares that after filling out the order form, he does not independently negotiate with the airline, otherwise the company is entitled to unilaterally terminate the contract and charge the passenger compensation for the expenses incurred as damages;
- Final Provisions
5.1 The company is authorized to periodically update the mentioned conditions unilaterally, however, the existing rules and conditions at the time of conclusion of the transaction will apply to the transactions already concluded;
5.2 By agreeing to the mentioned terms and conditions, the passenger confirms that he has fully familiarized himself with the standard conditions, that the specific conditions are not incomprehensible and/or vague for him and that he agrees with the legal nature of the contract.
5.3 Any dispute arising out of this Agreement shall be resolved through negotiation. In case of impossibility of negotiation, Tbilisi City Court will consider the dispute;
5.4 Any addendum attached to these Terms and Conditions constitutes an integral part thereof and shall be considered together with the Agreement;
